COMPETITION RULES

"Viking NORGIPS competition"

 

1. Competition organiser. Statements.

1) The organiser of this competition entitled: "Viking NORGIPS competition" (hereafter: "Competition") is NORGIPS Sp. z o.o. with its registered office in Warsaw at ul. Krakowiaków 50, 02-255 Warsaw, registered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw. Warsaw, XIII Economic Division of the National Court Register, under KRS No. 0000529680, NIP 5222702366, (hereinafter: "Organiser"). The competition will be conducted under the terms and conditions set out in these regulations (hereinafter: "Norgips") and is organised on the social networking site Facebook - accessible on the Internet at URL: https://www.facebook.com/norgips (hereinafter: "Competition site").

2) The Facebook page is operated on the basis of the Terms and Conditions for the "Facebook Page" service (URL: https://www.facebook.com/page_guidelines.php).

3) The Organiser informs that the Competition is not in any way or to any extent sponsored, endorsed, conducted, administered or associated with Facebook available on the Internet computer network at URL:

http://www.facebook.com

(hereinafter: "Facebook") or associated with it. In the event that, under Polish law, Facebook is responsible for violations of these Rules in a manner that cannot be excluded by the provisions of these Rules, participants should address their claims to the Organiser, as the entity guaranteeing the correctness of the Competition.

4) The Competition Organiser is not responsible for the impossibility of making a competition entry for reasons beyond the Organiser's control.

2. Venue of the Competition.

The competition will be conducted on the social networking site Facebook (hereinafter: "Service"), on the Organiser's account dedicated to the NORGIPS brand at: https://www.facebook.com/NORGIPS/

3. Duration of the Competition.

The competition will be held from 22.05.2025 at 9:00 a.m. until 30.05.2025 at 11:59 p.m. and the results will be announced by 05.06.2025 at 4:00 p.m.

4. Subject of the Competition.

The object of the Competition is to select, from among the contributions posted as part of the Competition, those which - in the opinion of the members of the Competition Committee referred to in point. 8 Rules - come up with a NORGIPS brand slogan, which will refer to the NORGIPS brand and the history of the Vikings. Enter your answer in a comment under the competition post. The authors of the above-mentioned contributions will be rewarded with the prizes indicated below under point. 10(1) of the Rules of Procedure.

The competition task is to come up with a NORGIPS brand slogan that reflects the brand and the Viking story. Enter your answer in a comment under the competition post.

As an added bonus, one Facebook user will be invited to the competition.

The authors of the abovementioned entries will be awarded the prizes indicated below under point. 10(1) of the Rules of Procedure.

5. Purpose of the Competition.

The competition is being run to build brand awareness and good relations with NORGIPS page watchers.

6. Conditions of participation in the Competition

1) The Competition is open only to natural persons who have full legal capacity, registered in accordance with the rules of the Site as users of the Site, and who meet the conditions set out in these Rules.

2) Employees and relatives of employees of the Organiser may not participate in the Competition.

3) It is a prerequisite to take part in the Competition and to become a participant in the Competition (hereinafter: "Participant") is to do the following (hereinafter: "Competition Entry"):

(a) posting within the Service, in the space indicated in para. 7 pp. 1) of the Regulations, the Competition Answer referred to in point. 7 of the Regulations, under the terms of the Competition Rules and in accordance with the rules of the Service;

b) providing the Organiser with your name, telephone number, home address and e-mail address, via the Service's communicator (Messenger).

4) Participation in the Competition is free of charge and voluntary.

5) By accepting the Terms and Conditions of the Competition, the Participant simultaneously declares that:

- by posting the Competition Answer referred to in point. 7 of the Regulations, in a comment under the competition post referred to in point. 7 of the Regulations, enters the Competition;

- he/she owns the copyrights to the  Competition Answer submitted in the Competition, referred to in point. 7 of the Regulations,

- the posting and publication of the  Contest Reply does not violate the rights or personal rights of any third party;

- he agrees to the publication of his Facebook ID in the posts on the Contest Site informing about the results of the Contest,

- provided his/her personal data voluntarily.

7. Competition rules.

1)  The competition task is to come up with a NORGIPS brand slogan that reflects the brand and the Viking story. Enter your answer in a comment under the competition post. As an added bonus, one Facebook user will be invited to enter the competition ("Competition Answer").

2)    Each Entrant may submit any number of  Competition Responses, with only one prize per Entrant.

Likewise, by publishing the Competition Answer, the Entrant declares (confirms) that he/she is the sole author of that Competition Answer and that the Entrant is entitled to (as a whole) unlimited personal and material copyright and neighbouring rights to it, and that the Competition Answer does not infringe any third party's copyrights, the rights of any person connected with the dissemination of his/her image, is free of any unauthorised borrowings, and that there are no other circumstances that could make the Organiser or the Controller liable towards third parties as a result of using the Competition Answer in the fields of exploitation listed in point 5 below. By publishing the Competition Answer, the Entrant also agrees and declares that the Competition Answer will be posted on the Internet without time and territorial restrictions within the scope of the Competition, i.e. in connection with the organisation of the Competition and the announcement of its outcome.

4)  Participants also agree and declare that they consent to the posting of their Competition Answers on Facebook without time and territorial restrictions within the scope of the Competition.

By publishing the Competition Answer, the Entrant agrees and declares that in the event that he/she receives the Prize (as defined in § 5 paragraphs 3 - 4 below), in exchange for that Prize, he/she transfers to the Organiser, without time and territorial restrictions, all proprietary copyrights to the awarded Competition Answer. The transfer of copyrights takes place in the following fields of exploitation: multiplication and recording by any technique of copies of the Competition answer, including in particular printing, reprography, magnetic recording, audio-visual technique, digital technique, lending and marketing, both the original and copies, dissemination, particularly in the Internet computer network, by means of entering into computer memory, regardless of the number of broadcasts, emissions, copies produced, public performance, exhibition, display, reproduction, as well as broadcasting, re-broadcasting, using the Competition answer in various forms of publishing and multimedia, including advertising and promotion on television, on paper, magnetic, optical and film carriers, making the Competition answer available to the public in such a way that everyone can have access to it in a time and place chosen by them. The above will be confirmed in a written statement by the Prize Winner signed at the Prize acceptance activity. The Entrant also agrees that the Organiser may transfer these rights to the Competition Answer, in whole or in part, to any third party at any time and to use the Competition Answer to create derivative works (modifications and transformations). The Organiser acquires these rights when the Prize is issued to the Laureate pursuant to Article 921 § 3 of the Civil Code. The Entrant is not entitled to remuneration for the use by any entity of the Competition Answer in any separate field of exploitation.

6)   The Organiser, subject to the provisions of clause. 7 below, expressly reserves the right to either delete the Contest Response or prevent access to the Contest Response (in accordance with the relevant functionalities made available by Facebook), as appropriate:

(a) in the event that it receives official notice or obtains credible knowledge of its unlawful nature;

b) in the event of receiving an official notification or obtaining information, or having a justified doubt that it contains racist content, content insulting another Entrant, vulgar, pornographic or indecent content, advertising content, content insulting a given religion or culture, content detrimental to the image of the Organiser, the entity indicated in point. 1(2) of these Terms and Conditions, the Controller or other entities associated with them, or otherwise contrary to the principles or norms of social coexistence;

c) for legitimate security reasons, insofar as this results from generally applicable legal provisions.

7) The Organiser reserves the right to exclude from the Contest Entrants whose actions contravene the law or these Rules and the Facebook Rules, in particular Entrants who:

(a) take actions using an account/profile created in violation of Facebook rules;

b) take action using a third party account/profile;

c) create a fictitious Facebook account/profile to avoid age verification;

d) do not meet any of the requirements for participation indicated in the Terms and Conditions.

8. Competition Committee.

1) The Competition Responses submitted to the Competition are subject to evaluation by the Competition Committee (hereinafter: "Competition Committee"), consisting of 3 members who are employees of the Organiser. The work of the Competition Committee is directed by the Chairman of the Competition Committee;

2) The Contest Committee will evaluate the submitted  Contest Answers at the latest 2 days after the end of the Contest and thus will select the Contest winners (hereinafter: "Winners").

9. Rules for determining Winners.

1) The Contest Committee - in the Contest - selects 3 (three) Winners, whose  Contest Responses - in the opinion of the Contest Committee - comply with the Contest Task. The selected Laureates will be assigned places one to three.

2) The Competition Committee has full discretion in its decision-making and, in particular, can adopt criteria for the selection of the Competition Answer based on subjective evaluations.

3) The decisions of the Competition Committee are final and not subject to change.

4) The results of the work of the Competition Committee (selection of the Winners) will be announced as set out in point. 11 of the Rules of Procedure.

10. Prizes in the Competition.

1)   The prizes in the Competition are:

  • The winners who, in the opinion of the Competition Committee, deserve a distinction will receive a Prize in the form of a set with the Viking logo: a metal key ring, a wooden breastplate and a metal mug worth PLN 90.29 gross.

2)  Each Entrant may be entitled to a maximum of one Prize in the Competition.

3)  Prizes are not exchangeable.

11. Announcement of Competition results.

The results will be announced within 6 days of the end of the Competition. The Organiser will announce the Winners each time in a separate post on the Contest Site and in a comment under the Contest post.

12. Exercise of the right to the Award. Issue of Awards.

1) The right to the Prize can be exercised on the condition that the Winner provides the Organiser with the details enabling the Organiser to transfer the Prize, as indicated in paragraph 3) below, i.e.: name, surname, address - to which the Prize will be sent - and telephone number, and signs a declaration of acceptance of the Prize.

2) The delivery of the Competition Prizes will take place within 14 working days of the announcement of the Competition results.

3) The Prizes shall be sent by the Organiser to the address provided by the Winner, by courier service, at the Organiser's expense, and their transfer shall be confirmed by the Winner's signature on the waybill.

13. Personal data protection

a) In order to carry out the Competition in accordance with the rules laid down in these Terms and Conditions, the Organiser shall process the personal data of the Participants.

b) The Controller of the personal data is the Organizer in the person of NORGIPS Sp. z o.o. with its registered office in /02-255/ Warsaw, ul. Krakowiaków 50.

The processing of personal data will be carried out in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR, and the Personal Data Protection Act of 10 May 2018 (consolidated text

(OJ U. of 2019, item 1781, as amended).

(c) The Personal Data Controller, when processing personal data or entrusting the processing thereof, shall take every care to ensure that the privacy of the Contest Participants is respected.

d) The personal data controller processes the following categories of data of the Contest Participants: name, surname, mailing address, contact telephone number, a-mail address and pseudonym, if used on the Participant's profile on Facebook - these data are provided in the application form.

e) Participants' personal data is collected and processed for the purposes of the Competition under the terms of these Regulations.

f) Participants' personal data will be processed for the purpose of possible investigation and defence of claims related to their participation in the Competition on the basis of Article 6(1)(f) of the GDPR.

g) Participants who provide personal data have the right to access the content of their data and, subject to the law, have the right to:

  • rectification of data,
  • erasure of data
  • restriction of data processing
  • data portability
  • object,
  • withdraw consent at any time.

(h) Participants have the right to lodge a complaint with the President of the Office for the Protection of Personal Data if they consider that their data is being processed unlawfully.

(i) The Participant, in the event of any queries or doubts regarding the processing of his/her personal data, may contact the Controller at the following email address: [email protected]

j) The provision of Participants' personal data to the Organiser is voluntary, although it is necessary in order to participate in the Competition.

k) The Organiser applies technical and organisational measures aimed at adequate, appropriate to the risks and categories of data protected, protection of the personal data collected. The Organiser has implemented appropriate measures to ensure a degree of security appropriate to the risk, taking into account the state of the art, the cost of implementation and the nature, scope, purpose and context of the processing and the risk of violation of the rights and freedoms of natural persons of varying probability and severity. The organiser shall take particular account of the risks involved in the processing of data arising from:

  • accidental or unlawful destruction,
  • loss, modification, unauthorised disclosure of data,
  • unauthorised access to  data  personal  transmitted, stored or otherwise processed.

l) The Organiser declares that Participants' data will not be subject to profiling.

 

14. Provision of services by electronic means

As the Competition is conducted using electronic technologies, the rules for the provision of services by electronic means are governed by the rules of the Facebook social network through which the Competition is conducted.

15. Complaints

All complaints concerning the course of the Competition, in particular the awarding of Prizes, must be submitted to the Organiser's address in writing within 14 days from the date of the end of the Competition. The date of lodging a complaint shall be the date on which it reaches the Organiser's address. The complaint should contain the name and address of the complainant along with a detailed description indicating the reason for the complaint. The Organiser will consider the complaint within 21 (in words: twenty-one) days of receiving the complaint and will inform the applicant in writing of its position.

16. FINAL PROVISIONS

1) The Regulations come into force on 22.05.2025.

2) The Regulations are available at the Organiser's office and on the website www.NORGIPS.pl . The above provisions shall apply mutatis mutandis to amendments to the Rules of Procedure.
